This agreement applies as between you, the User of this Website and KIC InnoEnergy SE, the owner(s) of this Website. - 10.7 The Website, which is Our online course platform, was developed as part of the European Solar Academy (ESA) activities for an EU action grant in the field of solar energy under the Competitiveness of Enterprises and SMEs strand of the Single Market Programme (SMP COSME). This project is implemented based on the Contribution Agreement between European Institute of Innovation and Technology (EIT) and European Commission DG GROW2 (Directorate General for Internal Market, Industry, Entrepreneurship and SMEs) signed in 2023, as well as the Grant Agreement signed between us and EIT in 2024 for the implementation of the actions of the European Solar Academy.
- 10.8 The data specified in points 1-4 above are necessary to create the Account, give you access to the Website, including access to online courses content and communicate with you. Upon meeting the completion requirements, the User's email address will be utilized to distribute the certificate.
- 10.9 The demographic data, specified in points 5-9, is necessary to fulfill our reporting obligations towards EIT based on the Grant Agreement. This data will be used in aggregate format included in our reports to EIT in line with the requirement to demonstrate the demographics of the learners that are participating in our courses. No information that allows for identification of individuals is shared. Our reports may be sent to the European Commission as fulfilment of the reporting obligations based on the Contribution Agreement. In public facing statements, we may also refer to the demographics of the learners that we train, and this will also be done in the aggregate form.
- 10.10 The Account must respect the following rules as a minimum:
- 10.10.1 Personal details must be accurate, verifiable, complete and up to date. A valid personal email address must be provided.
- 10.10.2 You agree not to use intermediary servers (also called proxies), whether for Account registration or connecting to the Account.
- 10.10.3 Automatic Account creation and/or Account creation using a false or fraudulent identity is strictly prohibited.
- 10.10.4 If any of your information changes, such as your mailing address or e-mail address, you must notify KIC InnoEnergy SE as soon as possible.

11.1 Either KIC InnoEnergy SE or you may terminate your Account. If We terminate your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, We reserve the right to terminate without giving reasons.

11.2 If We terminate your Account, you will no longer have access to the data collected in your Account. We will archive the Account until 5 years after final payment based on the Grant Agreement mentioned in sec. 10.9. You may contact us if you need specific information collected in your Account, for example, confirmation of completed courses.

12.1 The Website hosts an extensive online course library and is designed for practical, real-world application, ensuring relevance and usability in today’s dynamic energy landscape.
- 12.2 The Website and the Services are available for the Users free of charge. Users can access the online course content only via their Accounts on the Website.
- 12.3 Whilst every effort has been made to ensure that all general descriptions of Services available from KIC InnoEnergy SE correspond to the actual Services that will be provided to you, We are not responsible for any variations from these descriptions as the exact nature of the Services may vary depending on your individual requirements and circumstances.

12.4 We neither represent nor warrant that such Services will be available at all times. We can, without prior notice, disable access to the Website or limit its use, insofar as this is necessary for maintenance or adjustments or improvements to the Website or for any other reason, without this causing any right on compensation for the User towards KIC InnoEnergy SE.

13.1 KIC InnoEnergy SE shall use all Our reasonable endeavours to provide the Services with reasonable skill and care, commensurate with best trade practice.

- 14.2 The Services are provided immediately after the creation of the Account and are provided free of charge. You may withdraw from the agreement for the provision of the Services at any time by deleting your Account. You may also submit a statement of withdrawal from the agreement for the provision of the Services by sending it electronically to us at the following email: skillsinstitute.support@innoenergy.com. Afterward, we will delete your Account

23.1 All notices / communications shall be given to Us either by post to Our Premises (see address above) or by email to skillsinstitute.support@innoenergy.com. Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

23.2 We may from time to time, if you opt to receive it, send you information about Our products and/or services. If you do not wish to receive such information, please click on the ‘Unsubscribe’ link in any email which you receive from Us.
These Terms and Conditions and the relationship between you and KIC InnoEnergy SE shall be governed by and construed in accordance with the Dutch law. You agree that any dispute which cannot be settled amicably, shall be submitted to the competent courts in Amsterdam, The Netherlands.
